These Terms govern the use of
Vivid Graphics’ software-as-a-service application
“Vinculación numeros”
(the “Service”). By accessing or using the Service, you agree to these Terms.
1) The Service
The Service provides tools for automation and customer support, including integration with the WhatsApp Business Platform.
Use of WhatsApp features may require valid Meta/WhatsApp accounts and compliance with their policies.
2) Eligibility and accounts
- You must be able to form a binding contract and comply with applicable laws.
- If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
3) Acceptable use
You agree not to use the Service to:
- Send spam, unlawful, harmful, deceptive, or infringing content.
- Violate WhatsApp/Meta policies (including messaging rules for templates, opt-in/consent requirements, and prohibited content).
- Interfere with, disrupt, or attempt unauthorized access to the Service or related systems.
- Collect personal data without lawful basis or required consents.
4) WhatsApp Business Platform
If you connect WhatsApp Business accounts, you authorize the Service to perform messaging and management actions on your behalf
as configured (including actions supported by Meta permissions such as whatsapp_business_messaging and
whatsapp_business_management). You are responsible for ensuring your WhatsApp usage is compliant and that you
have the necessary rights and consents to message end users.
5) Customer data
You (or your business) are responsible for the content and personal data you upload or process through the Service (“Customer Data”).
You represent that you have all necessary rights and permissions to process Customer Data and to instruct us to process it on your behalf.

6) Intellectual property
We and our licensors retain all rights, title, and interest in and to the Service, including software, designs, and branding.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service.
7) Fees (if applicable)
Some features may require payment. If fees apply, we will disclose pricing and billing terms before you subscribe or pay.
Taxes may apply depending on your location.
8) Termination
You may stop using the Service at any time. We may suspend or terminate access if we believe you violated these Terms,
applicable law, or Meta/WhatsApp policies, or if required to protect the Service, users, or third parties.
9) Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of
merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
10) Limitation of liability
To the maximum extent permitted by law, Vivid Graphics will not be liable for indirect, incidental, special, consequential, or punitive damages,
or for loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service.
11) Governing law
These Terms are governed by the laws of Mexico. Any disputes will be handled in the competent courts of Querétaro, Mexico,
unless applicable law provides otherwise.

Condiciones de Servicio

Estas Condiciones regulan el uso de la aplicación de software como servicio de
Vivid Graphics
“Vinculación numeros” (el “Servicio”). Al acceder o usar el Servicio, aceptas estas Condiciones.
1) El Servicio
El Servicio ofrece herramientas de automatización y atención al cliente, incluyendo integración con la Plataforma de WhatsApp Business.
El uso de funciones de WhatsApp puede requerir cuentas válidas de Meta/WhatsApp y el cumplimiento de sus políticas.
2) Elegibilidad y cuentas
- Debes poder celebrar un contrato vinculante y cumplir con las leyes aplicables.
- Si creas una cuenta, eres responsable de mantener la confidencialidad de tus credenciales y de toda actividad realizada bajo tu cuenta.
3) Uso aceptable
Aceptas no usar el Servicio para:
- Enviar spam o contenido ilegal, dañino, engañoso o que infrinja derechos.
- Violar políticas de WhatsApp/Meta (incluyendo reglas de plantillas, requisitos de consentimiento/opt-in y contenido prohibido).
- Interferir, interrumpir o intentar acceso no autorizado al Servicio o sistemas relacionados.
- Recopilar o tratar datos personales sin base legal o sin consentimientos requeridos.
4) Plataforma de WhatsApp Business
Si conectas cuentas de WhatsApp Business, autorizas al Servicio a realizar acciones de mensajería y administración en tu nombre
según la configuración (incluyendo acciones soportadas por permisos de Meta como whatsapp_business_messaging y
whatsapp_business_management). Eres responsable de asegurar que tu uso de WhatsApp cumpla las políticas y que cuentas
con los derechos y consentimientos necesarios para contactar a usuarios finales.
5) Datos del cliente
Tú (o tu negocio) eres responsable del contenido y de los datos personales que cargues o trates a través del Servicio (“Datos del Cliente”).
Declaras que cuentas con los derechos y permisos necesarios para tratar dichos datos y para instruirnos a tratarlos en tu nombre.

6) Propiedad intelectual
Nosotros y nuestros licenciantes conservamos todos los derechos sobre el Servicio, incluyendo software, diseños y marca.
Sujeto a tu cumplimiento de estas Condiciones, te otorgamos una licencia limitada, no exclusiva e intransferible para usar el Servicio.
7) Tarifas (si aplica)
Algunas funciones pueden requerir pago. Si aplican tarifas, informaremos precios y condiciones de cobro antes de que te suscribas o pagues.
Pueden aplicar impuestos según tu ubicación.
8) Terminación
Puedes dejar de usar el Servicio en cualquier momento. Podemos suspender o terminar el acceso si consideramos que violaste estas Condiciones,
la ley aplicable o políticas de Meta/WhatsApp, o si es necesario para proteger el Servicio, usuarios o terceros.
9) Exención de garantías
El Servicio se proporciona “tal cual” y “según disponibilidad”. En la máxima medida permitida por ley, excluimos garantías de
comercialización, idoneidad para un fin particular y no infracción. No garantizamos funcionamiento ininterrumpido o libre de errores.
10) Limitación de responsabilidad
En la máxima medida permitida por ley, Vivid Graphics no será responsable por daños indirectos, incidentales, especiales, consecuentes o punitivos,
ni por pérdida de utilidades, ingresos, datos o reputación, derivados de o relacionados con el uso del Servicio.
11) Ley aplicable
Estas Condiciones se rigen por las leyes de México. Cualquier controversia se resolverá ante los tribunales competentes de Querétaro, México,
salvo que la legislación aplicable disponga lo contrario.
