This Privacy Policy applies to Vivid Graphics and our software-as-a-service application “Vinculación numeros” (the “App”), which integrates with the WhatsApp Business Platform and may request Meta permissions including whatsapp_business_messaging and whatsapp_business_management.

1) Scope

This Policy explains how we collect, use, store, and protect personal data when you interact with our App and services, including when you communicate with us through WhatsApp or when the App helps our business users manage WhatsApp Business messaging and settings.

2) Data we collect

Depending on how you use the App and WhatsApp, we may collect or process:

  • Identity & contact data: name and WhatsApp phone number.
  • WhatsApp profile data: profile photo (if available through WhatsApp/Meta and provided to us via the platform).
  • Message content and metadata: messages you send, messages we send, timestamps, delivery/read status, and conversation context.
  • Technical data: IP address, device/browser information (where applicable), logs and diagnostics.
  • Templates: WhatsApp message templates used for notifications (where applicable).

3) How we use your data

We process data to:

  • Provide, operate, and improve the App (SaaS) and customer support.
  • Enable WhatsApp-based customer service and automation workflows (e.g., routing, tagging, autoresponses) initiated by the user.
  • Send notifications through WhatsApp when you have initiated contact, provided your number, and/or when applicable consent/opt-in exists for template notifications.
  • Maintain security, prevent abuse/fraud, and troubleshoot issues.
  • Comply with legal obligations and enforce our terms.

4) Legal basis (Mexico)

We process personal data in accordance with applicable Mexican law, including the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP), based on one or more of the following: providing requested services, legitimate purposes such as security, and where required, your consent (e.g., certain notifications/marketing).

5) WhatsApp Business & Meta permissions

Our App may access and use the WhatsApp Business Platform via Meta to:

  • whatsapp_business_messaging: send and receive WhatsApp messages on behalf of the connected WhatsApp Business account(s), including automation and customer support.
  • whatsapp_business_management: manage WhatsApp Business account settings, phone number connections, and related configuration needed for messaging operations.

We only use these permissions to provide the App’s features and do not use them for unrelated purposes. WhatsApp communications are subject to Meta/WhatsApp platform terms and policies.

6) Sharing and disclosure

We do not sell your personal data. We do not share your personal data with third parties for their independent marketing. However, our services rely on certain providers to operate (for example, infrastructure/hosting, email, and the WhatsApp/Meta platform). These providers may process data on our behalf to deliver the service, under appropriate safeguards.

7) International transfers

Some service providers (including Meta/WhatsApp and cloud infrastructure) may process data on servers located outside Mexico. When this occurs, we apply reasonable safeguards and require providers to protect data consistent with this Policy.

8) Data retention

We retain personal data only as long as necessary for the purposes described in this Policy, including: providing the service, resolving disputes, maintaining security logs, and meeting legal/accounting obligations. Conversation history and logs may be retained for operational continuity unless you request deletion where applicable.

9) Security

We implement reasonable administrative, technical, and physical safeguards to protect personal data against loss, misuse, unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is 100% secure, but we work to protect your data using industry-standard practices.

10) Your rights and how to request deletion

You may request access, correction, cancellation/deletion, or objection (ARCO rights where applicable), and you may also request deletion of your data. 11) Children’s privacy

Our services are not intended for children under 13 (or the minimum age required by local law), and we do not knowingly collect personal data from children.

12) Cookies and analytics

If our website or App uses cookies or similar technologies, we use them to keep the service working, improve performance, and understand usage. Where required, we will request consent for non-essential cookies.

13) Changes to this Policy

We may update this Policy from time to time. We will post the updated version on this page and update the “Last updated” date. Material changes may be communicated through the App or via other appropriate means.
